Terms of Service

01 Access and acceptance

These Terms govern your use of CharHaven. If you do not agree with them, do not create an account or continue using the service.

02 Account Security

Keep your login details secure and report suspected account access to CharHaven promptly.
You are responsible for authorized activity through your account and for taking reasonable steps to protect your credentials.
CharHaven may restrict or end access when an account violates these Terms or the Community Guidelines.

03 Content Standards & Age Appropriateness

CharHaven is an 18+ platform. All content uploaded, shared, or displayed on CharHaven must comply with the following standards:

Content Rating Requirement: All content containing sexual, violent, or otherwise mature themes must be tagged as "Mature (18+)" by the uploader. Failure to tag mature content appropriately is a violation of these terms.

General Content: Visible to all users by default. Must be appropriate for audiences aged 18+.
Mature Content (18+): Must be tagged with the mature content flag. Hidden by default. Only accessible to authenticated users aged 18+ who have explicitly consented.
Prohibited Content: The following is banned regardless of tagging — child sexual abuse material (CSAM), sexual depictions of minors (real or fictional), non-consensual sexual content, real-world violence/gore/terrorism, hate speech, doxxing, and promotion of self-harm.

CharHaven reserves the right to remove any content that, in our sole judgment, violates these standards. For the full list of content rules and behavioral expectations, see our Community Guidelines.

04 Age Requirements & Minor Safety

You must be at least 18 years of age to create a CharHaven account.
People under 18 may not create or use a CharHaven account. Mature content is additionally hidden by default and requires an authenticated adult user to opt in.
Credible findings that an adult solicited, groomed, or exploited a minor may result in permanent termination and escalation to relevant authorities when required or appropriate under applicable law.
If we discover an account belongs to a person under 18, we will disable it promptly and delete or retain associated data only as required for safety, evidence preservation, and applicable law.

05 Content Ownership & License

You retain ownership of the original content you create and upload to CharHaven. By posting content on the service, you grant CharHaven a limited, non-exclusive, worldwide, royalty-free license to host, cache, reproduce, format, distribute, and display that content solely as needed to operate, improve, secure, and promote the service. This license ends within a commercially reasonable period after the content is deleted from active systems, subject to backup retention, legal obligations, and dispute-resolution needs.

Fan works and third-party intellectual property: CharHaven is not affiliated with, sponsored by, or endorsed by any referenced franchise, game studio, publisher, artist, or rights holder. You must label unofficial fan work, must not use branding in a way that suggests official affiliation, and must have permission or another lawful basis for every text and image you upload. Do not sell or monetize content based on third-party intellectual property unless you have authorization to do so.

06 Copyright Notice and Takedown

CharHaven respects intellectual property rights and accepts copyright notices under applicable law, including notices formatted to contain the information ordinarily required by the U.S. Digital Millennium Copyright Act (DMCA). If you believe your copyrighted work has been used without authorization on our platform:

We review sufficiently detailed notices, may remove or disable access while a claim is evaluated, notify the affected uploader when appropriate, accept counter-notices, and take escalating action against repeat infringement. This process does not claim that CharHaven has completed any registration required to obtain a particular statutory safe harbor.

07 Restricted Conduct

The following activities are strictly prohibited within the network:

Illegal activity or content

Harassment, bullying, or threatening messages

Unauthorized data collection or scraping

Bypassing content filters or safety systems

Uploading untagged explicit/mature content

Creating accounts under the minimum age

08 Membership Plans & Virtual Goods

Some CharHaven features are offered as paid memberships, supporter perks, or virtual goods. Prices, benefits, eligibility rules, and the external checkout provider will be identified on the relevant purchase page before checkout. Cancellation stops future renewals where supported, and paid benefits generally remain available until the end of the active billing period unless the purchase is refunded, reversed, or terminated for fraud or abuse.

09 Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". CHARHAVEN AND ITS OPERATORS, ADMINISTRATORS, AND AFFILIATES DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

Maximum Liability Cap: To the fullest extent permitted by applicable law, CharHaven's total aggregate liability to you for all claims arising out of or relating to these Terms or the use of the Service shall not exceed the greater of (a) the total amount you have paid to CharHaven in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred United States dollars (USD $100). This limitation applies regardless of the form of action, whether in contract, tort, strict liability, or otherwise.

10 Governing Law & Dispute Resolution

These Terms are governed by the law that applies to CharHaven's operator and to you. Nothing in these Terms removes consumer, privacy, or procedural rights that cannot legally be waived.

Informal Resolution First: Before filing any formal claim, you agree to contact us at admin@charhaven.com and attempt to resolve the dispute informally in good faith for at least thirty (30) days.
Formal Claims: If informal resolution fails, either party may use a court or other dispute process available under applicable law. Venue and procedure will be determined by the law that actually applies rather than by an unspecified or automatic waiver.

11 User Content Responsibility

CharHaven hosts user-generated content and also publishes its own materials. Users are responsible for the content they create, upload, share, and distribute; CharHaven is responsible for its own materials and for operating the service as required by applicable law. Hosting or moderating user content does not mean CharHaven endorses, verifies, or guarantees its accuracy.

You represent and warrant that you have the right to post all content you upload, and that such content does not infringe any third party's intellectual property, privacy, or other rights.
You acknowledge that other users' content may be offensive, inaccurate, or otherwise objectionable. CharHaven shall not be liable for any user-generated content, whether or not it violates these Terms.
CharHaven may monitor, review, restrict, or remove user content to enforce these Terms, reduce harm, respond to notices, protect the service, or comply with applicable law.

12 Intermediary Role and Moderation

CharHaven provides tools through which users create and share content. The allocation of responsibility between CharHaven and a user is determined by the law that actually applies; these Terms do not assume that any specific statutory immunity or safe harbor is available.

USERS ARE RESPONSIBLE FOR THE CONTENT THEY POST. CHARHAVEN MAY MODERATE, RESTRICT, PRESERVE, OR REMOVE CONTENT TO ENFORCE THESE TERMS, PROTECT USERS, RESPOND TO NOTICES, AND COMPLY WITH APPLICABLE LAW.

This does not limit our right or obligation to remove content that violates these Terms, applicable law, or our Community Guidelines.

13 Account Termination & Data

You may terminate your account at any time via Settings → Delete Account.
Upon deletion, your profile and user-facing content are removed from active public access within a reasonable processing period, subject to technical queues, dependency cleanup, and lawful retention needs.
Some records may remain in backups, audit logs, fraud-prevention systems, or unresolved moderation records for a limited period after deletion.
CharHaven may suspend or terminate accounts that violate these Terms, create safety risk, abuse platform systems, or expose the service to legal or operational harm.

14 Virtual Currency (Haven Coins)

Haven Coins are a virtual currency used exclusively within the CharHaven platform.
Haven Coins have no real-world monetary value and cannot be exchanged, refunded, or transferred outside the platform.
Haven Coins may be used to purchase cosmetic items, profile upgrades, and other platform features as available.
Unused Haven Coins are non-refundable and will be forfeited upon account deletion.

15 Membership Plans & Refunds

Memberships and virtual purchases are billed through the checkout flow shown at the time of purchase. Taxes, processor fees, and currency conversion may vary by region or payment method.
If a subscription renews automatically, you can cancel before the next renewal date to avoid future billing. Ending a plan does not retroactively refund already delivered access unless required by law or expressly approved by support.
Refund requests are reviewed case by case. Approved refunds may result in the removal of purchased perks, coins, cosmetics, or related account benefits.
Fraudulent payment activity, abusive refund behavior, or unauthorized chargebacks may result in purchase restrictions, perk removal, account suspension, or permanent termination.

16 AI-Generated Content

CharHaven may offer AI-powered tools (such as AI Studio) for character creation and content generation. By using these tools:

Rights in AI-assisted output depend on applicable law and the extent of human authorship. CharHaven does not promise that purely machine-generated output is copyrightable or exclusive.
CharHaven makes no warranty regarding the accuracy, originality, or fitness of AI-generated output.
AI-generated content must comply with the same content standards as user-created content, including mature content tagging requirements.

17 Third-Party Services

CharHaven integrates with or links to third-party identity, checkout, media, bot-protection, hosting, analytics, email-delivery, and content-delivery services. The active providers and data categories are identified in the Privacy Policy and at the point of use where appropriate. External services operate under their own terms, privacy notices, and availability commitments. Third-party names and marks are used only to identify interoperable services, remain the property of their respective owners, and do not imply affiliation, sponsorship, or endorsement.

18 Indemnification

You agree, to the extent permitted by applicable law, to indemnify, defend, and hold harmless CharHaven, its administrators, and affiliates from third-party claims, liabilities, damages, or reasonable expenses arising from your unlawful use of the service, your material violation of these Terms, or your infringement of another person's rights. This clause does not remove rights or remedies that cannot legally be waived.

19 Changes to These Terms

CharHaven may update these Terms from time to time to reflect product changes, legal requirements, security needs, or operational improvements. When changes are material, we will make a reasonable effort to notify users through the site, email, or in-product announcements before or when the changes take effect. Continued use of CharHaven after the effective date of updated Terms constitutes acceptance of the revised Terms.
